Honda actually just settled over that. Their Civic hybrid was advertised to get mad mpg and a number of owners weren't getting anywhere near what they were supposed to get.

That's like my Hyundai Accent. It was supposed to get 33 highway. The best we ever got was about 24 highway. And that was a long, straight run to Cabela's and back, all flat highway. My new turbocharged SUV has hit 28 on an un-broken in motor. Do you find this valuable?
